REQUIREMENTS AND CONDITION FOR CLASS R WORK PERMIT (NATIONALS OF EAC MEMBER STATES)

Immigration series 9

This permit is issued to a person who is a citizen of a Member State of the East African Community and is not a Prohibited Immigrant and who intends to reside, engage in employment, activity, business, trade or engage in any prescribed profession and whose presence will be of benefit to Kenya.

Who Qualifies?

A citizen of a Member State of the East African Community and is not a Prohibited Immigrant and who intends to reside, engage in employment, activity, business, trade or engage in any prescribed profession and whose presence will be of benefit to Kenya.

The requirements are:

  • Duly filled and signed Form 25.
  • Applicant’s copy of valid national passport (bio-data page).
  • Applicant’s most recent passport size colored photograph.
  • Current Immigration status if in the country (where applicable).
  • Cover letter from the organization/employer addressed to the Director General of Immigration Services.
  • Certificate of registration of the organization or business.
  • Applicant’s academic certificate/professional certificates.
  • For Investors -Proof Capital investment for investors (bank statement).
  • Proof of land ownership or lease for farmers (copy of title/lease and current search).
  • Shareholding certificate (CR 12) for investors.
  • Proof of source of income for residents.
  • For Missionaries:
  • Letter from sending religious society in home country;
  • Proof of registration of sending religious society in home country;
  • Details of sending religious society (HQ) i.e., Physical address, Telephone number, Email address;
  • Contact details of senior official of sending religious society i.e., Name, Title (e.g. Bishop, Sheikh, Priest), Telephone number and Email address.
  • Supporting letter from local umbrella religious body i.e., Supkem, Hindu Council, Sikh Union or any other recognized religious body.
  • Documentary proof of training in religious faith.
  • Certificate of ordination (where applicable).
  • Details of work station: -Name, place, Church/Mosque, City and its Physical address i.e., Location, road/street/town/village, county, Telephone number, Email address. Contact Person i.e., Name, Title, Telephone number.
  • For renewals; Tax Compliance Certificate (Individual/employer)., Investors to produce tax compliance certificate for company (we will have upon incorporation), Labourers and small-scale traders to provide police clearance certificate (Kenya).
  • Applicable fees (Gratis)

Note: Legal fees for company set up and permit application may be applicable where necessary.

Other permit conditions

  1. It is an offence for a person to knowingly mislead an Immigration Officer when applying for this permit.
  2. Incomplete applications shall not be accepted.
  3. Additional documents may be requested in addition to the list above.
  4. Where the holder of a work permit ceases to engage in the employment in respect of which the work permit was issued, the employer specified in the work permit shall, within fifteen (15) days from the date of such cessation, report, in writing to the director that the holder has ceased to engage in such employment.
