OVERVIEW OF RE-ENTRY PASS IN KENYA

(Immigration Kenya: series 6)

Registration of Re-entry pass is governed by the Kenya Citizenship and Immigration Act of 2011 and regulation 35 of the Kenya Citizenship Regulations 2012.

A holder of a dependant pass, who is lawfully in Kenya, who intends to leave Kenya temporarily or who, having left Kenya temporarily and having been at the time of his or her departure lawfully present in Kenya, failed for reasons which an immigration officer is satisfied are good and sufficient reasons, to apply for a re-entry pass before his departure, may apply to an immigration officer, for a re-entry pass.

Who Qualifies?

Re-entry passes are only issued to holders of Dependant passes.

What are the requirements?

Below are the requirements for a re-entry pass:

  1. A dully filled and signed application form 36.
  2. The original passport of the dependant and a copy of the same.
  3. The original and copy of work permit if the principal is a resident.
  4. The original and copy of Kenyan passport if the principal is a Kenyan.
  5. The original and copy of dependant pass.
  6. Applicant’s email, phone number and post office address.

Applicable fees and validity period

The processing fee of a re-entry pass is Kshs. 5,000 per year.

The pass can be issued up to a Maximum period of 2 years.

Other Conditions

  1. Any person contravening requirement or provision concerning a re-entry pass commits an offence and is liable to imprisonment of fine or both.
  2. One must upload all the required documents when making the application.
  3. Re-entry fee is non-refundable.
  4. Incomplete application will not be accepted.
  5. Holders are prohibited from engaging in any form of business or employment without a requisite permit or pass.
  6. Giving false or misleading information is an offence punishable by law.
  7. An immigration officer shall, after considering an application for re-entry pass shall endorse a re-entry pass, in the holder’s passport, if he is satisfied that the presence of the applicant in Kenya on re-entry would be lawful otherwise than by virtue of the re-entry pass.
  8. A re-entry pass shall, subject to the terms and conditions specified in the pass, entitle the holder to re-enter Kenya at any time and from time to time during the period of validity
